THIS SWEEPSTAKES IS INTENDED FOR PLAY BY LEGAL RESIDENTS OF THE UNITED STATES AND THE DISTRICT OF COLUMBIA, WHO ARE EIGHTEEN (18) YEARS OF AGE OR OLDER AS OF THE DATE OF PARTICIPATION AND WILL BE GOVERNED BY U.S. LAW. DO NOT PARTICIPATE UNLESS YOU ARE ELIGIBLE AT THE TIME OF PARTICIPATION.

  1. ELIGIBILITY: The 2018 DANNON® Danimals® Show Us Your Momfidence Sweepstakes (“Sweepstakes”) is open only to legal residents of the fifty (50) United States and the District of Columbia, who are eighteen (18) years of age or older at time of participation. Void in Puerto Rico and where prohibited by law. Employees, officers and directors of The Dannon Company, LLC (“Sponsor”), Young America LLC (“Administrator”) and their respective parent companies, affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, fulfillment, public relations, marketing, and promotion agencies, website providers, and any other individuals engaged in any way in the development, production, printing, distribution, or execution of this Sweepstakes, and members of the immediate families (defined as spouse, children, siblings, parents, and their respective spouses and in-laws, regardless of where they reside) and households (whether or not related) of any of the above are not eligible to participate. By participating, participants agree to these Official Rules and the decisions of the Sponsor and/or its Administrator which are final and binding in all respects.

  2. SWEEPSTAKES PERIOD: Sweepstakes begins on April 26, 2018 and ends on June 16, 2018 (“Sweepstakes Period”).

  3. HOW TO PARTICIPATE: During the Sweepstakes Period, go to the Dannon Danimals Facebook page (www.facebook.com/danimals) and post a picture of yourself and your child(ren) having a “Momfidence” moment with the hashtags #MomfidenceMoment and #Sweepstakes on the Danimals page. Upon posting on the Danimals Facebook page, you automatically will be entered with one (1) entry into the Sweepstakes. You must include each required hashtag to be eligible and win. All potential winners are subject to verification before any prize will be awarded. Limit: LIMIT ONE (1) ENTRY PER PERSON/HOUSEHOLD. ANY USE OF MULTIPLE FACEBOOK PROFILES TO GAIN ADDITIONAL ENTRIES WILL BE CONSIDERED INVALID. ADDITIONAL ENTRIES WILL BE DISQUALIFIED. Entries must be submitted by the contestant. CONTESTANT WARRANTS IT IS THE PARENT AND/OR LEGAL GUARDIAN OF THE CHILD(REN) IN ITS ENTRY AND AUTHORIZES SUCH CHILD(REN)’S INCLUSION IN THE ENTRY. Any attempt by any participant to obtain more than the stated number of plays and/or entries by using multiple and/or different identities, forms, email addresses, or any other methods will void that participant’s plays and/or entries, and that participant may be disqualified at Sponsor’s discretion. Multiple participants are not permitted to share the same Facebook account. In the event of a dispute as to any registration or play, the authorized account holder of the Facebook profile used to register will be deemed to be the registrant or player. The “authorized account holder” is the natural person assigned the account on Facebook. Potential winners may be required to show proof of being the authorized account holder to the Sponsor or forfeit the prize. Incomplete, illegible, corrupted or untimely entries are void and will be disqualified.

    Sponsor and Sponsor’s agents, affiliates, subsidiaries, representatives or service providers may use entrants’ personal information submitted with entry for purposes of prize fulfillment and/or for future marketing by Sponsor, such as to notify them of a product or promotion that Sponsor thinks may be of interest.

    Sweepstakes is in no way sponsored, endorsed or administered by Facebook. If you enter, you are providing your information to Sponsor, not to Facebook.

  4. SELECTION OF WINNER: On or about June 19th, Sponsor will select the name of the potential winner of the prize in a random drawing from among all entries received. The odds of winning are based on the number of eligible entries received. The potential Winner will be notified by direct message on Facebook on or about June 25th, Except where legally prohibited, the potential Grand Prize winner must sign and return, within seven (7) days of being notified, an Affidavit of Eligibility and Liability & Publicity Release in order to claim his/her prize. If a potential Winner cannot be contacted in person via direct message after the first attempt to contact him/her, or if he/she fails to sign and return the Affidavit of Eligibility, Liability & Publicity Release or Declaration of Compliance within the required time period (if applicable), or in the event that a potential Winner is disqualified for any reason, Sponsor will award the applicable prize to an alternate winner selected by random drawing from among all remaining eligible entries. Only one alternate drawing will be held, after which any remaining prizes will remain un-awarded.

    Verification of Potential Winners: ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE SWEEPSTAKES. AN ENTRANT IS NOT A WINNER OF ANY PRIZE UNLESS AND UNTIL ENTRANT’S ELIGIBILITY HAS BEEN VERIFIED AND ENTRANT HAS BEEN NOTIFIED THAT VERIFICATION IS COMPLETE. All materials submitted become the property of Sponsor and will not be returned.

  5. PRIZE DETAILS: One (1) Grand Prize: Grand Prize winner will receive a one (1) year supply of select Dannon Danimals products, consisting of twelve (12) total shipments of select Dannon Danimals product(s). Exact product type, flavor, amount of product, and shipment dates as determined in Dannon’s sole discretion and based upon product availability. In the event Dannon Danimals products are not available for shipment or products are no longer produced or otherwise not available, no compensation or substitution for such portion of prize will be provided other than as determined in the sole discretion of Sponsor.

    THE RELEASED PARTIES (AS HEREINAFTER DEFINED) SHALL HAVE NO LIABILITY FOR ANY PERSONAL INJURIES, DEATH, PROPERTY DAMAGE, OR OTHER DAMAGES OR EXPENSES RESULTING FROM OR ARISING OUT OF ANY USE OF THE PRIZE OR ANY OTHER ASPECT OF PRIZE WINNER’S ACCEPTANCE OR USE OF THE PRIZE.

    Total ARV of the Prize is $197.40. If a winner cannot accept the prize as stated, prize may be forfeited. Prize cannot be substituted, assigned, transferred or redeemed for cash; however Dannon reserves the right, at its sole discretion, to substitute prize of equal or greater value if the advertised prize is unavailable. Each winner is responsible for any loss of prize or portion of any prize after it has been delivered. Sponsor will not replace any lost or stolen prizes. Limit one (1) Prize per person/household.

  6. GENERAL CONDITIONS:

    By entering, participants agree (and agree to confirm in writing) that: (a) Sponsor, Administrator, their respective parents, subsidiaries, related and affiliated entities, partners, members, representatives, consultants, contractors, legal counsel, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents (collectively, the “Released Parties”) are released, will have no liability whatsoever for, and shall be held harmless by participants against any liability for any injuries, losses or damages of any kind to person(s) including, without limitation, death or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in this Sweepstakes or any Sweepstakes-related activities including, without limitation, any consumption of product; (b) except where legally prohibited, winners grant (and agree to confirm that grant in writing) permission to Sponsor and those acting under its authority the right to the use of his/her, and his/her child[ren] included within entry, name, picture, likeness, voice, biographical information and statements for advertising, trade, publicity and promotional purposes without additional compensation, in all media now known or hereafter discovered, worldwide in perpetuity, and on the Internet and World Wide Web, without notice, review or approval, unless prohibited by law; (c) any portion of the prize not accepted or used by the winner will be forfeited; and (d) Sponsor is not responsible for any inability of the winner to accept or use any prize (or any portion thereof) for any reason. Each winner shall bear all risk of loss or damage to their prize after it has been delivered.

  7. WINNER NOTIFICATION: Each potential Prize winner will be contacted by phone, email and/or mail. Each Prize winner will be required to complete, sign and return an Affidavit of Eligibility, a Liability Release, and where lawful, a Publicity Release within seven (7) days of date of notification via fax, email and/or overnight mail. Sponsor is not responsible for suspended or discontinued Internet or wireless service which may result in potential winner not receiving initial prize notification. Sponsor is not responsible for any change in participant’s email, mailing address and/or telephone number. If a potential winner is found not to be eligible or not in compliance with these Official Rules, if any required documents are not returned in a timely manner, if Sponsor is unable to contact a potential winner within a reasonable time period, or if prize notification is returned as undeliverable, the potential winner may be disqualified.

    The value of any prize awarded to a winner may be reported for tax purposes. Prize winners will be issued an IRS 1099 Form for the retail value of the prize. All federal, state and local taxes, if any, on prize and any other costs and expenses associated with prize acceptance and use not specified herein as being provided are solely winner’s responsibility, regardless of whether it, in whole or in part, is used. All prizes are awarded “as is” and Sponsor makes no representations or warranties of any kind concerning the appearance, safety or performance of any prize or while participating in such prize; except for any express manufacturer’s warranty as may be included with the prize. Any unclaimed prize or portion of prize will not be awarded. If a prize is returned as undeliverable, prize may be forfeited and Sponsor shall have no further liability to award that prize. Please see the privacy policy located at www.dannon.com/privacy.aspx for details of Sponsor’s policy regarding the use of personal information collected in connection with this Sweepstakes. If you are verified as the prize winner, your first name, last initial, city and state will be included in a publicly-available winner’s list.

  8. DISCLAIMERS: Released Parties are not responsible for lost, late, stolen, incomplete, illegible, inaccurate, mutilated, postage due, undelivered, delayed or misdirected mail, prize claims, or prizes; or for any error or problem of any kind relating to or in connection with the Sweepstakes including, without limitation, errors or problems which may occur in connection with the administration of the Sweepstakes, the announcement of the prizes, or other activities in connection therewith, or in any Sweepstakes-related materials. You are not a winner until you have complied with all terms of these Official Rules. Only the number of prizes stated in the Official Rules will be awarded.

  9. DISPUTES: Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the federal, state and local courts located in Westchester County, New York; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred (if any), including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased; and (4) each entrants’ and prize winners’ remedies are limited to a claim for money damages (if any) and each entrant and prize winner irrevocably waive any right to seek injunctive or equitable relief.

  10. GOVERNING LAW AND JURISDICTION: By participating, participant agrees that all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York without giving effect to any choice of law or conflict of law rules, and any matters or proceedings which are not subject to arbitration as set forth in these Official Rules and/or for entering any judgment on an arbitration award, shall take place in the State of New York, in the County of Westchester. By participating, participants consent to the jurisdiction and venue of the federal, state, and local courts located in Westchester County, New York.
